So just had a new client on the phone and during the discussion, he happens to say that he seen one of my images in a paper he was reading in a hotel, but the company in question has never had any work from me, so I can only assume that they have ripped the images from my website or the likes and used them in their advertisements.

So where do you go from here, is it something worth pursuing or will it be a dead end. I'm thinking some of you will already have been through the same and know the score.

first find the paper in question and confirm it is one of yours, then what i normally do is write to the company and ask them to explain why they are using it and add a cease using it and ask for the location of everywhere it is being used . they normally say sorry and remove straight away ( they dont really have a choice).

I'll contact the paper today and see what info I can get from that.

The guy reckons theres no doubt its the same image i sent them as an example so we'll see soon enough.

if you can go there and fetch the brochure do so, and send a copy to your lawyer.
Don't try to do this kind of thing on your own, let a lawyer handle it. Play badass.

At the end of any conversation you have with the alleged offender, say "or else."

Also, find out where they live and frequently bump into them by accident.... maybe follow some of the perps to a store, and before they come back out, stand in a parking space next to their car while holding a leash tied to a dead fish... dont say anything when your approached, just stare.

I'd think there would be some major problems if they made money off this paper..

Legally couldn't you press for them to pay you a certain amount if they did make money off the paper?

like kb said, 'sorry' won't cover the load and damage has been done (ie. they stole and used your intelectual property).

obtain as much evidence of it as possible and sue for damages
sueing is a nobrainer since you can prove it's yours and they used it already
in which case they'll have to pay you damages in line of how much/long and where they have used it
and.. they'll have to cover your lawyer cost as well

use reverse images search by google as well to see where your image pops up too

go for it

Look like it was a lot of fuss over nothing.

The client cut out the advert in question and posted it up to me, and i was ready to go with a letter but for obvious reasons didnt want to send anything till I seen it with my own eyes.

Turns out it wasnt one of my images, though the same image is in my portfolio. Bascially its the 'before ' shot in a photo manipulation job I done. Another client gave me the photo which I beleive belongs to them, but they dont exist anymore. They asked for the house to be changed, neighbouring houses to be taken off etc, so in the portfolio theres a before and after shot.
