bitch of a bartender...
show user profile  Bolteon
alright mates and mate-ettes...

usually i would post a drunken message in regards to how i love you all and the such, regardless the afformentioned is true; but i'm actually in need of some opinions here.

(it's my decision to make all my future drunken threads to some what an avail, benifiting people in at least some way, this is mainly to discourage the youngins from posting up pointless threads as ti seems some unfortunetly follow my ways)

---

couple of weeks ago, i went to a bar. drank a bit, but the service was horrid. my tab at the end of the night to my recolection was 167 us dollars.

a week later, my card was run 260 dollars, an amount i never to my recolection authorized.

what i do recolect, is getting yelled at by the "regulars" hated bar tender, implying i'm not allowed to be allowed inside from this point on.

---

fast forward a few emails the the bar owner, and his reluctance to take my, the customers side. in the end i filled a coflict of charges with my checking card company.

as of yet, i have not heard a confirmation or denial from the bar via my check card company / bank.

tonight, i went to enter the bar and the said bar tender was present. i was denied to even enter, regardless of my intent to be serviced.

the best part was when i actually met the owner and he himself denied me entrace due to the bar tenders personal preferance on the matter.

----

so the question is ladies and gents, is a bar allowed not only to deny service (which only at the bar encompases the sale of alcoholic beverages, as they dont charge for cover/entrance) but admitance to the place based on the liking of supposed customers.

up to you peoples. am i out of line, or am i just in the matter....

p.s. love you all, yes i'm a bit tipsy; and yes this is the best put together paragraph ever for a drunkard.

well.

here i go.

a bar, of any sort refuses service to anyone, as they may please.

such said service includes what the bar may offer you in return for a denomination of currancy.

if the bar doesn't charge a cover to get in, they legally have to let in anyone; as they aren't covered by the statuate that they refuse service to anyone.

service of such said place includes serving drinks and nothing more. if they charged a cover, then that too would be part of their service as it allows you entrace to a place where your able to continue buying their goods.

as it stands, the place doesn't charge cover. and what i'm disputing is while they have ever right to refust me service, they are legally obligated to let me in at least; regardless of whether they sell me anything inside there.

personally, i love the fact that the owner is already sweating via the couple of emails profusing that they have the right to refuse people service.

i think i'll reem him for everyting he ownes, stating that the night he denied me entrance that there was a feasible associate of my friends who could have or could not have offered me a job that night that would substantially kill my income over the next ten years.

god i love law. and fucking over jerks.

Yeah Bolts unfortunately they do reserve the right to refuse service to customers. Only certain circumstances would they be held accountable for refusal of services, such as if they are discriminating against you. You would have to then prove that they are discriminating against you because of race, sex, or religion.

However, if you need to dispute your charges for that night, then you are in every right to dispute them and they can not refuse you entrance when the reason you are going their is to discuss improper charges.

So call your local police, ask them that you want to dispute the charges on your bill and that the owner refuses to clarify the matter.

If the owner is unwilling to cooperate, then it means he is guilty of something and you can bring up charges of fraud/theft against him.

He's not asking whether they have a right to refuse service. He's asking if they have the right to refuse entry, since they don't charge for that.

Amish Bob: Yeah it'd be really annoying to bring an Image Hosted by triped icon to the bar. :)

Refusal of entrance and services go hand in hand. Yes they have the right to refuse entry. It'd be kind of stupid to allow one and refuse the other. Sure come into our bar, but you aren't allowed to have a drink, or sure come and have a drink, but you can't come into the bar.

I also still made note, that they can't refuse entrance to you if you are trying to clarify improper charges.

All businesses Have the right too , Reserve the right to refuse service to any one, and that includes entry on premises(in American law). Even if its just because they don't like your nose, Hair, or feet, they just cant audibly make it discriminatory.<---that last sentence is just me throwing in some under the table shit, its not written law
Providence protects children and idiots. I know because I have tested it.

Depends where you live, if you live in the states then they are allowed to refuse entry regardless of whether they charge or not, because you get special permission to enter the premises; other wise you are trespassing and are dealt in the same fashion. As long as the owner owns that property; it’s the same deal as letting someone go in for an open house if your selling your house.

In Canada they have the same right to say you are a trespasser as in the states, In fact I have been kicked out of a bar and almost called a trespasser for merely being an associate of a bar fighter. I have no idea what the laws are in Britain, but since their constitution is entirely decided by the courts (in other words unwritten) you would have to check there.

However overcharging is highly illegal, sounds like someone skimmed your credit card. Best advice is too cancel those cards; and file a dispute with law enforcement and the bank. Sadly unless things are resolved legal wise it is unlikely you will ever get a refund. However you can get the bartender put in jail on charges of skimming and theft.
